These Terms of Service govern your use of mohio.io and our related websites, including the About page and mohioU (the “Sites”). By accessing or using the Sites, you agree to these terms. If you do not agree, please do not use the Sites.

The Sites are operated by Particular LLC, which does business as Mohio and Mohiolang, located in Charlotte / Mooresville, North Carolina, USA. In these terms, “we,” “us,” and “our” mean Particular LLC. You can reach us at legal@mohio.io.

The Sites are informational. They describe the Mohio programming language, the Pioneer Program, and mohioU, and they let you join a waitlist or apply to early-access programs. The Mohio language and software themselves are made available separately and are governed by their own licenses, described below, rather than by these website terms.

The Mohio language and base compiler are open source under the Apache License 2.0. Commercial components, including certified sector profiles, the hosted runtime and platform, and compliance dashboards, are offered under separate commercial terms. Your use of any Mohio software is governed by the license that accompanies it, not by these Sites terms. If there is a conflict, the software license controls for the software.

Content on the Sites, including text, design, graphics, and layout, is owned by Particular LLC or its licensors and is protected by intellectual property laws. MOHIO is a trademark of Particular LLC (trademark application filed). Certain Mohio innovations are the subject of provisional patent applications (patent pending).

You may refer to Mohio factually, but you may not use our names, logos, or trademarks in a way that suggests endorsement or affiliation without our written permission.

Participation in the Pioneer Program (including the Young Pioneer track) is free and voluntary. There is no contract, cost, or obligation, and we may change, pause, or end the program at any time.

Applicants aged 13 to 17 must apply with a parent or guardian who consents to participation and stays involved. We do not knowingly enroll anyone under 13. With your permission, we may mention you as an early user; we will not do so without it.

When using the Sites, you agree not to:

  • use them for any unlawful purpose;
  • attempt to gain unauthorized access to, probe, or disrupt the Sites or their security;
  • scrape or use automated tools in a way that burdens or harms the service;
  • impersonate any person or misrepresent your affiliation;
  • upload or transmit malicious code.

Mohio is in active, pre-public development. Roadmaps, timelines, milestones, and feature descriptions on the Sites are aspirational and may change without notice. Nothing on the Sites is a promise of future functionality, availability, or performance.

Important. Mohio’s sector features activate technical enforcement controls. They do not guarantee legal or regulatory compliance. Mohio is a tool, not legal advice, and using it does not create a compliance, attorney-client, or advisory relationship.

You remain responsible for your own legal and regulatory obligations, and you should consult qualified legal counsel for compliance decisions. Technical enforcement controls reduce certain risks; they do not replace professional judgment.

The Sites and all materials are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Sites will be uninterrupted, error-free, or secure. Warranties for any Mohio software are governed solely by that software’s license.

To the fullest extent permitted by law, Particular LLC and its members will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Sites. Our total liability for any claim relating to the Sites will not exceed the greater of the amount you paid us for the Sites (which is typically zero) or USD 100.

The Sites link to third-party services such as GitHub, Discord, and Hugging Face. We do not control and are not responsible for their content, terms, or privacy practices. Your use of those services is governed by their own terms.

You agree to indemnify and hold harmless Particular LLC from any claims, losses, or expenses arising out of your misuse of the Sites or your violation of these terms.

These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in North Carolina will have exclusive jurisdiction over any dispute relating to these terms or the Sites.

We may update these terms from time to time. We will post the revised date at the top of this page, and continued use of the Sites after changes means you accept them. Questions about these terms can go to legal@mohio.io.

Mohio and Mohiolang are DBAs of Particular LLC, based in Charlotte / Mooresville, North Carolina, USA. This Privacy Policy explains what information we collect through mohio.io and our related sites, how we use it, and your choices. We collect information you choose to provide, including:

  • Waitlist: your email address.
  • Pioneer Program applications: your name, email, the sector you work in or what you build, and your birthday.
  • For applicants aged 13 to 17: a parent or guardian’s name and email, and their consent to participate.
  • Messages: anything you include when you contact us or add a note to a form.

We do not require you to create an account.

Like most websites, our host keeps standard server logs (such as IP address, browser type, and pages requested) to operate and secure the Sites. Some features, described under Cookies below, may also collect limited technical data when they load.

We use the information to operate the waitlist and Pioneer Program, to contact you about early access and occasional milestones, to tailor age-appropriate guidance, to keep the Sites secure, and to improve Mohio. We use your birthday to send age-appropriate communications and the occasional birthday greeting. We never display your birthday publicly.

We do not sell or rent your personal information, and we do not share it for third-party advertising.

We have no plans to do so. If that ever changes, we would update this policy first and give you a meaningful choice.

To run the Sites, we use a small number of providers who process limited data on our behalf, only to provide their service:

  • Form processing for waitlist and application submissions;
  • Spam protection on our forms (Google reCAPTCHA);
  • Web fonts (Google Fonts);
  • Web hosting for the Sites.

These providers are not permitted to use your information for their own purposes. We do not currently use third-party advertising or analytics services.

We keep cookies to a minimum. Google reCAPTCHA and Google Fonts may set cookies or collect technical data when those features load on a page. We do not use third-party advertising or analytics cookies at this time. If we add analytics in the future, we will update this policy.

The Young Pioneer track is for builders aged 13 to 17. We collect a minor’s information only with the involvement and consent of a parent or guardian, whose name and email we also collect so they stay in the loop.

We do not knowingly collect personal information from children under 13. If you believe a child under 13 has given us information, contact hello@mohio.io and we will delete it. A parent or guardian may review, correct, or request deletion of their child’s information at any time.

We keep waitlist and application information for as long as we need it to run the program and our relationship with you, then delete or anonymize it. You can ask us to delete your information sooner at any time.

You can ask us to access, correct, or delete your information, or to stop contacting you, by emailing hello@mohio.io. Depending on where you live (for example the EU, the UK, or California), you may have additional rights over your personal information. Contact us and we will honor the rights that apply to you.

We take reasonable measures to protect your information, including encryption in transit and limited internal access. No method of transmission or storage is perfectly secure, so we cannot guarantee absolute security. To report a security concern, email security@mohio.io.

We are based in the United States. If you contact us or submit information from outside the US, your information will be processed in the US, which may have different data-protection rules than your home country.
